Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Knewflash (“Knewflash”, “we”, “us”) and govern your use of the Knewflash mobile app, website, and related services (together, the “Service”). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use Knewflash. We ask for your date of birth at sign-up and block accounts that report an age under 16. You also confirm that you are not barred from using the Service under the laws of your country or any sanctions list, and that any information you give us is accurate.

2. Your account

Your account is identified by a phone number and a handle that you choose. You are responsible for keeping your phone number under your control, because the phone number is what signs you in. You may not transfer your account, sell it, or let anyone else use it. We may refuse, reclaim, or rename handles that impersonate someone else, infringe a trademark, are offensive, or are otherwise abusive.

3. How Knewflash works

Knewflash is a media-sharing service where reactions to other people’s posts are themselves first-class content. When you post a flash, you choose its audience:

  • Public — visible to any Knewflash user.
  • Friends-only — visible to your friends on Knewflash. The poster can see who has viewed the post.
  • Private — sent to a single friend as a flash message inside your one-to-one conversation. Private flashes do not appear in any feed, search, or profile grid.

Some flashes are posted as “blind”, meaning they are blurred behind a tap-to-reveal gate. Posters can be shown viewer lists for friends-only flashes and view receipts for private flashes, as described in the Privacy Policy.

4. Acceptable use

You agree not to use Knewflash to do, post, or share anything that:

  • is illegal, infringes someone else’s rights, or violates any applicable law;
  • sexually exploits or endangers a minor in any way, including any sexual content depicting people under 18;
  • contains non-consensual intimate imagery, doxxing, or otherwise reveals another person’s private information without permission;
  • threatens, harasses, bullies, or incites violence or hatred against anyone;
  • promotes self-harm, suicide, eating disorders, or other content that endangers users’ health;
  • promotes terrorism, organised crime, or organised hate groups;
  • contains spam, scams, phishing, malware, or unwanted commercial solicitation;
  • impersonates another person or misrepresents your affiliation with anyone;
  • scrapes, mirrors, reverse-engineers, or interferes with the Service or any other user’s use of it;
  • circumvents safety, blocking, age, or moderation features.

We may remove content and suspend or terminate accounts that we believe violate these rules, with or without notice.

5. Your content

You keep ownership of the photos, videos, captions, and messages you create on Knewflash (your “Content”).

5.1 Licence to operate the Service

To run the Service for you and the people you post to, you grant Knewflash a non-exclusive, worldwide, royalty-free licence to host, store, transmit, transcode, cache, display, reformat, and adapt your Content as needed to operate, secure, and improve the Service, deliver it to the audiences you choose, run safety and moderation systems, and back it up. This licence ends for newly posted Content when you delete your account, except for backups, audit logs, and copies retained for safety and abuse investigations as described in the Privacy Policy.

5.2 Promotional use of your non-private content

By posting Content on Knewflash with a public or friends-only audience, you also grant Knewflash a non-exclusive, worldwide, royalty-free, sub-licensable licence to use, reproduce, adapt, edit, and display that Content — together with your handle and profile photo — in Knewflash’s own marketing and advertising materials. Typical uses include screenshots, in-app spotlights, the Knewflash website, App Store and Google Play listings, social media posts, and paid advertising for Knewflash.

This promotional licence covers only Content with a public or friends-only audience. Private flashes (sent to a single friend), direct messages, view receipts, and your moderation history are excluded and are not used in advertising. We will not pair your Content with an endorsement of a third-party brand without your separate permission.

If you delete your account, we stop using your Content in new promotional materials, but copies already distributed in finished campaigns may remain in circulation.

5.3 Reactions and chains

When someone reacts to your flash, their reaction is a new piece of Content owned by them. You acknowledge that Knewflash will display reactions and the chain relationship between a flash and its reactions to people who can see those flashes.

5.4 Responsibility for your content

You are responsible for the Content you post. You confirm that you have all the rights needed to post it and to grant the licences above, and that your Content does not violate anyone else’s rights or the Acceptable Use rules in section 4.

6. Feedback

If you send us suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use it without restriction or compensation. We are not obliged to keep feedback confidential.

7. Copyright and DMCA

If you believe Content on Knewflash infringes your copyright, send a notice to contact@strixthekiet.me including: identification of the work, the URL or location of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is not authorised, a statement under penalty of perjury that your notice is accurate and that you are the rights-holder or authorised to act for them, and your physical or electronic signature. We will respond to valid notices and, where appropriate, remove the Content and act against repeat infringers.

8. Reporting and moderation

You can report Content or users from inside the app. Reports are reviewed by our moderation team. We may remove Content, hide it, restrict accounts, or take other action at our discretion. Moderation decisions are not appeals court rulings — we aim to be fair but not to litigate every call.

9. Suspension and termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have broken these Terms, created risk for us or for other users, or if we are required to do so by law. You can delete your account at any time from Settings → Delete account. Sections 5 (your Content licences, to the extent already exercised), 6 (Feedback), 10 (Disclaimers), 11 (Limitation of liability), 12 (Indemnity), and 14 (Governing law) survive termination.

10. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Knewflash disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your requirements. We are not responsible for Content posted by other users.

11. Limitation of liability

To the maximum extent permitted by law, Knewflash will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages.

The Service is provided free of charge. To the maximum extent permitted by law, Knewflash’s total monetary liability to you for any and all claims relating to the Service is zero. Some jurisdictions do not allow the exclusion of certain damages or liability; in those jurisdictions our liability is limited to the smallest amount permitted by law.

12. Indemnity

You agree to defend, indemnify, and hold harmless Knewflash and its operators against any claim, demand, loss, or expense (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms.

13. Changes to the Terms

We may update these Terms from time to time. If we make a material change we will update the effective date above and, where appropriate, surface the change in the app before it takes effect. Continuing to use Knewflash after a change means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Knewflash’s operator is established, without regard to its conflict-of-laws rules. Disputes will be brought in the courts of that jurisdiction, except where mandatory consumer-protection law in your country gives you a non-waivable right to bring proceedings locally.
